Commission Settles Sleepwear Allegations

WASHINGTON, DC -- The U.S. Consumer Product Safety Commission (CPSC) today announced it has accepted a Consent Order Agreement negotiated with PCA Apparel Industries, Inc. a manufacturer of children's sleepwear headquartered in New York City. PCA has agreed to pay a civil penalty of $75,000 to settle (CPSC) staff allegations that in manufacturing children's sleepwear garments, it did not fully comply with the testing and recordkeeping requirements that apply to piping and other trim on its garments under the Commission's standards for the flammability of children's sleepwear. PCA has now modified its procedures to ensure full compliance with CPSC standards.

While agreeing to settle this matter, PCA did not concede that it violated the law, but indicated that the payment is to settle the Commission's claim.

The Commission staff has investigated other firms for similar violations and uncovered similar violations. Other firms have agreed to correct such violative practices. The staff is seeking civil penalties in other sleepwear cases.
